China's high court rules employers can't work employees overtime with
no pay
China’s top court tells businesses they can no longer use a 996 work schedule in order to work folks like a mule for six days a week, 12 hours each day from 9AM to 9PM with no overtime pay.
Chinese law specifically says that an employer may work an employee 8 hours a day, 44 hours a week, before they have to pay for overtime.
Therefore, if an employee works 45 hours or more during the week, then the employee gets overtime pay. Otherwise, the employee gets the regular pay that is due to him or her.
“Legally, workers have the right to corresponding compensation and rest times or holidays. Complying with national working hours is the obligation of employers,” is what the BBC folks quoted China’s high court as saying.
The court came to its decision after reviewing a slew of cases from workers in the construction, media, and tech industries. Right now, there are many of you reading this and going, “Huh?!”
And that’s understandable. China is the poster child for worker’s abuse. The sweatshops, child laborers, and folks working themselves to death is nothing new for China. It’s what they do. It’s just that what they do has left many folks done in.
Just take, for instance, the “tan ping,” meaning to “lie flat,” movement whereby the young folks protest the 996 work schedule by lying down. Get it?! Instead of being up on their feet working like a dog all day, Chinese workers lie down and rest their dogs (feet) all day.
President for Life Xi Jinping and his Communists Party Poopers don’t like the “tan ping” movement or any other protests the young folks or ol’ folks are doing. However, they can’t go all “Tiananmen Square Tank Man” on the young folks because it will add to China’s worker shortage problem. Killing off workers who are protesting your killing them off by working them to death will not solve the worker shortage problem.
Things are different, now. China doesn’t have enough workers living to take over the shifts of the non-living. Therefore, President of Life Xi Jinping and his Communists Party Poopers had the high courts to rule in favor of the living workers so they will have living workers to do the work that China needs them to do in order to make China an empire again.
